    Hello,
    My wife's Advanced Parole document has wrong date of birth. Her EAD card too had wrong DOB; we have sent it back to USCIS. She's planning to visit India next month. She has a valid H4 visa stamp.

    Is it ok for her to travel to India? Do you see any issues while coming back.

    I have not used AP to enter so far but I do not believe AP is related to employment and questions related to that should not be asked when entering the country if one is using AP to enter. Just IMHO

    Hi All,
    I have H1B stamped from company A which is valid untill Oct 2008. I am planning to go to India in Jan on my new transferred H1B from company B.

    Do I have to take an appointment in India for getting my new H1 stamped? Or can i just show my new approved H1B from company B on my port of entry in US, when I come back?

    Any suggestion on a good immigration Attorney in NY state ? Please recomend. Employer says I can use my own attorney. So I need to find a good Attornye who can file PERM in NY state as the employer is in NY/NJ area

    USCIS has not extended its temporary accommodation for delays in the labor condition application (LCA) process. Earlier, USCIS agreed to accept H-1B petitions without a certified LCA, in certain situations, for a limited time. This exception was available from November 5, 2009 to March 9, 2010. The USCIS has declined to extend this exception. Accordingly, all H-1B petitions must be filed with the certified LCA otherwise USCIS will deny the H-1B petition or extension.

    Hence, it again is necessary to have an Approved LCA in place for the proper location at the time of the H-1B filing. The reason the exception was not extended is that the DOL assured USCIS that LCAs are being processed within the required seven-day processing time. The DOL, in fact, stated that LCAs are being processed within four to five days which is in fact true as well. It is our suggestion to plan accordingly.

    Hello,

    My I-140 was approved in August 2009 and my PD is Jan-2004 (EB3). I want to know when i can apply for I-485, should i have to wait till my PD becomes Current or is there any other way by which i can file the I-485. Please shed some light on this topic and thanks for your time and effort.

    You need to wait for your PD become current...may be in 2019.

    I joined company ABC on H1B in 2005.
    In Nov 2006 company XYZ filed my GC.


    H1B got transferred to a couple of companies because I changed jobs while GC was being processed in parallel without being affected by my job changes because it was filed by another company.

    In Oct 2007 got my EAD for a period of 1 year. Kept working on H1B only though.
    EAD expired in Oct 2008. Applied for a new card but never received it. Did not apply for one after that.
    In Nov 2009, I quit my job and moved back to home country giving up my H1B while still not affecting my GC because company XYZ agreed to keep it under process.

    So at this time, I have no H1B and no EAD card. My priority date is however going to be current soon.
    Now...

    1) Do I have to be in the country before my dates get current or can I do that later?
    2) On what status do I enter?
    3) Can I delay the process somehow without affecting my GC?

    Let�s pick up on Craig Barrett's suggestion: "We should just staple a green card to every advanced degree granted to a foreign national from a US university in science and engineering,"

    It has been stated before, but never followed up seriously.

    May be adding it to "What Immigration Voice wants to do?" would be a start�
