Really disappointing. Senator Schumer says on the one hand that the targeted companies are not violating the law and on the other says they are underpaying their workers - which would be a violation of the law. Which is it? And he disparages the entire staffing industry - an industry that in the US employs far more American citizens than immigrants - by questioning the legitimacy of the business model and complaining that these companies don't make anything. Gurus, I am on H-1B visa doing a project with 'abc' client who is the client of 'X' company and pays to my H-1B employer 'Y', I get paid from 'Y'. I started on this project on H-1B visa but now I have EAD(spouse of primary applicant) and want to change my status to EAD. The X company says that they have non compete agreement with Y company(my employer) and can't bring me on board unless I get email from my employer stating they have no objection me moving to EAD. My employer is not ready to give me that email(for obvious reasons.. after all it is a desi employer).
I want to find out if there is a way out..also I never signed any agreement with my employer..in fact I don't even have a copy of offer letter. The only agreement I have is with X company that I can't go back to the same client for one year, the day I end this project. I am based in Boston MA.

It means Advance Parole. You will be eligible to apply for AP if your application for adjustment of status is pending with USCIS, and you need this document to re enter the US from overseas travel.

I am currently waiting on my 485 (EB2). My priority date is Sept 16 2005, and 485 date is Aug 27 2007. I have traveled out of the country and back on advance parole and am still on H1 as I am still with the same company. My current advance parole ends in Jan 31 2010. I have to travel again in the first week of Feb 2010. I applied for another advance parole at the TSC on Aug 31 2009 for both my Wife and I. My Wife got her parole in a week, but I am yet to receive it.
I checked the USCIS site for the time frame and it says 3 months for TSC. I am thinking I might not have received it yet as I have a parole which is active. But I want to make the travel reservations now and I wanted a confirmed parole. USCIS said that they could put in an expedited request for the parole if it is an emergency. My lawyer says not to worry as I had applied in August, I had plenty of time to receive it.
Please advice. What should I do.

Today I rceived someone else's EAD. We received three EADs, one each for me and my wife and another adressed to me with EAD inside being some one else's.

Hello All,
I have my H1B immigration interview in New delhi on NOV 4th. I am not sure if this is a problem or not. In 2009 (Nov - Jan) I worked for a small company for designing websites. That employer doesnt have any of my details except my name . But, he said I am on his payroll and issued me few company cheques( I am on OPT at that time). At Feb I need to apply for my OPT extension, that small company dint give me their e verified number so I quit that job and joined a consultancy and applied for OPT extension. I got a new job in March. Now consultancy people filed for my H1 and it got approved. Now I am flying to India and need to get my H1 stamped. Would there be any problem about my last job where they dont have any of my details except my name?

Currently I'm working for a major software firm (10,000+ employees) as a senior software engineer. My 6-yr H1-B expires by January 2010.
I filed for PERM with PD of October 2007 in Atlanta center under EB2 category for Sr.Software engineer position. As we know it is still in PENDING status after a AUDIT request.
Now, I have received an offer for a Sr.Technical Program manager internally in my company.
What are my options now?
1. Can I withdraw my current PERM (while it is PENDING after AUDIT) and apply for a new PERM under new position? OR
2. Can I use the same PERM since I'm staying with the same company?
3. Does the company size help in any way?

I just renewed my H1B for another 3 years and my manager just said that since I have my H1B, I shouldnt renew my EAD/AP when it expires next year since it is quite an expense for the company. My wife is using her EAD for her current job and so that will still be renewed.
Just wanted to find out if there can be any issues if I dont renew just my EAD/AP?
Also after filing for the I485 in July 07, we did our Fingerprinting in Feb 08. We had not received FP notice and had to go through infopass to get FP done. Since then we've not received a renewal for FP again. I believe FP expires in 18 months and we need get it done again. Should I be receiving FP notice for renewal or do I need to go thru infopass again?

Labor, I140 approved and I-485 filed during July-07. Have EAD and AP but never used it. Still on H1B, extended for 3 years based on approved I140 and valid until Dec 2011. With my GC employer all along, employer is applying for LCA now as my new client is located in different state. My questions are:
� Whether there will be any impact on my ongoing GC process if the job description on this new LCA is different?
� If anything goes wrong with this LCA, whether there will be any impact on my existing H1 and eventually on GC process?
� If something wrong happens to my H1, can I still switch to EAD after that?
� What is the process to move from H1B to EAD within the same company, is filing new I-9 with EAD detail is suffice?
