    Guys, I could use some suggestions here. I had filed for my and wife's EAD on July 30th. My wife wasn't working and my EAD is valid until mid-November. However recently my wife got a job offer and will starting work next week. Her EAD actually expires 15th Oct. Reading through posts it seems that the chances of her receiving EAD approval within 75 days is highly unlikely. Can anyone give suggestions on what is the best course of action to follow to ensure she doesn't have to take a break soon after joining?

    Hi all,
    I have posted my case details but here it is again. I got a reject on my H1 after receiving 221(g) form. Same old reason cited in the letter. The case reached USCIS on 28th Jan and no progress after that.
    My husband works for the same company and he got his visa stamped after 221(g). Now i am planning to apply for H4. I have a few questions.
    1)Can i go for H4 stamping without revoking my earlier H1? Will i be asked to revoke my H1?
    2)Since my husband works for the same firm and i got a reject working for the same firm, can my H4 be a problem?
    3)Can it be a problem to my husband's H1 who got it stamped successfully and is already in the US?
    4)My idea of not revoking H1 is because i want to try a COS once i am in US, which some people have done it successfully. But does anyone know if this has to be done before April, before the new H1B quota opens up?

    We got an approval and CPO email on my husbands (primaries) application. Nothing on mine yet but I would not be surprised if both come together. PD Dec 2005 RD July 2 2007

    I am on H1B and planning to go for CP. I have to fill the form DS-230 for this and submit to VSF office.

    Currently I am on H1B extension and I don't have visa stamped for this extension on my passport.

    In this form DS-230 I need to fill field name "Present Address".

    I have following question:
    - In this form what should I fill my present address
    Indian address
    OR
    US address.

    (what I think: I think when I will submit the forms to VSF I will be in india and at that time i will not have the valid visa to enter USA. So I think I should fill the indian address.)

    What do you guys suggest?

    Yes, as long as the new job is same/similar to job B. The 180 days count is number of calendar days i-485 is pending, not number of days on the job. One may not even be working at all during that 180 days, or even while waiting for i-485 approval however, must have a very good excuse because IOs will be very suspicious. It is not violating any rules though as i-485 is for future employment.

    Hello Senior Members,

    I have just started a thread to ask if there is any need to call our local senators for co-sponsoring S.3084 ( Barbara Boxer), which is identical bill in Senate for HR 6039.

    Is core working to get similar bills for HR.5882 and HR 5921 to get introduced in Senate?

    Something new I'm starting. USCIS puts out weekly data on the use of H-1B visas for the 2011 fiscal year which starts in October. I'm going to monitor that for readers and add my own projection on the months the caps are likely to be hit.     My last H1 transfer gave me a 3yr H1 approval. But in reality, this will make it 1 year more than the 6 years allowed. My Perm and 140 are approved before the 6th year ended and my company filed a H1B amendment request just a day before 6th year ended. It is still pending. Now, my wife is in india and she has to get back here for filing 485 in july. Can I use my existing H1 to apply for visa in this situation?

    Here is my situation, my PD is March 05 and my 140 is pending for the past 3 months. Do you guys think if I get my 140 approved by Premium processing it would increase my chances of 485 approval this fiscal year? BTW, as its obvious from my PD I will be filing my 485 in July, God willing.

    On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200.     On March 12 2009 I got an query on my I-485.
    Requesting discrepancy in the labor applied on Nov'7 2002 and present working place.

    My company(abc ltd) applied labor on Nov'07 2002 while I was working at the clients(xyz) place in Los Angeles.

    I got my I-140 approved on Feb'15 2006, while I was with the same client(xyz) at that time.

    On Dec'04 2006 I moved to Detroit, started working with different client.

    RFE goes like this.

    The Documentation submitted with your application and/or a review of service records indicate that you no longer reside in the same state or geographical location as the underlying form i-140 immigration petitioner and /or job location specified by your intended permanent employer.

    There fore submit a currently dated letter from your original form I-140 employer which which address this discrepancy.

    I am still working with the same employer who filed my labor certification.


    Any gurus who can suggest me on the query would be greatly appreciated.

    For applying green card...you don't need any special work visa like h1b etc.. What you need is a sponsorship for your greencard under EB2/EB3 categories. You can research more on that in this forum and also at immigration.com website.

    You can get reimbursement for all eligible expenses but you will not get the tax benefit. The taxes due on that amount will be accounted for at the time of filing your return. You can submit claims and get them reimbursed.
