Hi,
I had a H1-b visa until September 2008 from Company A. I transferred the H1-B to Company B and it was approved in December 2008. When I went for my stamping in March 2009 it was denied under 221(g). My employer then withdrew the H1-B petition because of lack of projects. I am now planning to apply for a B1/B2 visa at the Mumbai Consulate. Any one have a similar experience to share or have an idea on my chances of sucess?

Dear Sir/Madam,
I am planning to move back to India after I get the green card, possibly in the next 2-3 years. I really want the green card for my son (15 years old) who is very keen to come back to the US. If I take him to India to do his undergrad degree in India, will he be able to maintain his green card even if I am not present in US. I can give my brother's address (who lives in Chicago and is a green card holder) as my son's home in US. Will Rentry permit every 2 years for my son work? Or should I wait untill citizenship which seems to be too far considering my PD is nov 2007 EB2. Please advise.

My friend filed I-140 and I-485 concurrently on 8/6/2007. His lawyer just got a rejection letter (not RFE) from INS due to the I-140 filing fee problem: The expected filing fee is $475 and the check in his filed package is $425. It is a $50 different. Does anybody have the similar situation as my friend ? And
how do you guys handle this prolem ? Any suggestion is appreciated.

I posted this message earlier in some other thread. Actually my questions were irrelevant to the thread I added the message on. Hence, creating a new thread.
I have couple of questions regarding GC filing for future employment.
a. Is it legal to work for company B if one is working for company A and company A has already filed LC?
b. Any danger of getting audit because of multiple LCs?

No. You can't port PD from spouse.
You can port your own PD, if you have another EB3 approved.
You can port the country of chargeability, if she was born in another (ROW) country.
My priority date is in 10/2006 under EB3. My wife just start her GC process under EB2. Can my wife port my PD date to her GC application?

I think there was a change in the rules for re-entry permits - you have to submit for biometrics before you leave the U.S. - so the auntie may not be able to apply for re-entry permit if she is outside the U.S.

There is no relation between your first FP and FIrst EAD.
Your EAD card will come the message ' FP not available."
Sequence is fine...you should get your card in mail anytime now.

Hello everyone,
I have heard that if you cancel your first LC and apply for a Second one you can still use the advertisements and all from the first one if you fall withing that "6 month" period. My question is -
Is it 6 month from the first day that the advertisement was published or is it 6 month from the day your first LC was approved? :confused:
Experts please shed some light on this.

Say if one has two I-140 and wish to port the priority from the older one to the later one. And if the USCIS does not agree with your filing(maybe they will say the filing is not possible or not portable). What will they do? Will they deny the I-485 or will they just reject the application. If so will it cause an issue when the later priority date is reached and during the application of the following I-485.

I am currently attending a college here in China. However, I have been offered some interesting jobs . These jobs require that I have a resident visa. I have been told that I can't change from a student visa to a resident visa, while in mainland China. Is this accurate? If so, is Hong Kong an option for me?

I am generally a lurker in this website. Based on the other threads, I came to the reality there is no way I am getting my GC for another 4-5 years or may be even longer.
However, the USCIS site has a status "Card/Document production". The last status update date was 6/25/2010. The only update I could think of is my new address around the same time. I went to the USCIS status website after 2 years out of curious, after I got back from giving my finger prints (3rd since I485 filing) today.
Is the USCIS jerking me off? :rolleyes:

My sister applied for her EAD renewal online and paid $340 for it. She filed her I 485 in Oct 2007. There are instructions on the I 765 form that there is no fee for those who filed there first EAD after July 2007. So would that fee be refunded? Has anyone experienced this kind of thing?

I am here in US working for a company on L1 Visa. My Visa and I-94 expires on November 2010. The company has already applied for my H1. I am planning for a vacation to India in August. I have the following question,
1. When I comes back to US from my vacation, in September, I dont have to go to the consulate, as my L1 is still valid. And I wont be able to go to the consulate for H1 stamping, as they wouldnt have started the stamping for this year, right?
2. Once I am back in L1, do I have to go back to India for H1 stamping, as my L1 expires in November?
3. Or the best method is to visit India after October and get it stamped with H1 from the consulate while coming back from India?

I was laid off in early April, and the employer told me that they would revoke my H1B 30 days later (early May).
Now finally I get a job offer. The new employer can start to work on my h1b now, but the starting date will be late July.
I have an EAD right now based on my approved 140 and pending 485 (>=180days)
I talked with my attorney, and he said I would definitely have to go back to re-activate my H1B abroad, so I should use EAD instead of doing H1B.
Is it true that I have to go abroad to re-activate my h1B? I saw some people transferred sucessfully
