Inspite of the new spillover policy and the additional FB visa's the EB2-I has retrogressed. This shows there is quite a bit of EB2-I demand. Regarding EB3I movement, donno when it will come out of the 2001 slump. The actual bulletin might show the ROW movement that could provide some hint to how the spillover can influence the EB2I forward movements.

The reason CIS isnt processing EB3 for last 3 months is because the dates are U and since they have lot of pressure not to waste visa numbers they have put all resources into EB2.
I have seen EB2 cases filed in May-08 been approved.
But i know this is unfair for EB3 people like us waiting for over a yr.

It certainly is a bad news..
guys my PD is april 2004, does that mean I stand no chance. I had RFE on 08/14.Should I still keep hopes till the end of the month, or its all over for me till my date gets current again...Senior members plsssssssss respond...

ind_game, just a heads up : when the 485 is reopened they take the op'ty to review the app for all supporting docs. meaning if you have not submitted any supporting docs like birth cert etc they would issue an RFE. They did to me, back in Jul-07 i had submitted only parents affidavit but no BC or NABC. And they gave me only 30 days (i think it used be 90 days for RFE), I had hard time collecting the required info/doc in such a short time.

this is a 2004 EB3 approval! This is the first one I am seeing from 2004. So looks like they have really cleaned the pipes here, and things should be better going forward.
The nicest thing of this whole fiasco is that they seem to have ignored country-limits and approved as many as possible. Last year they did only 9.8K EB Indians (teh final count was 17k, but that was due to ScheduleA). THis year (2007) if they have gotten 20-30K India applications out, the dates should move better in the future.
Eagerly awaiting 2 USCIS stats:
1. per-country per-category EB approvals in 2007
2. number of 485 applications received by August 17th
They indeed are clearing up the pipes, so the situation is not as horrible as it seems to be. A pd of 2004 is considered "old" so as soon as visa nos become available in october, they would be the first ones to get approved.

Few observations based on thread postings
1) Last year around this same time not many RFE/LUD were seen.
2) Most of these cases with RFE/LUD are either EB2 around 2005-2006 or EB3 2003-2004
3) My Lawyer based out of IL confirming RFEs are in high volume and majority of these are Employment verification with Birth verification and Health letter verification as close second.
Now given the gov attitude and the current scenario it does not seem that they would be interested in pre-adjudication. There is something else that is going on. On the same note I am also seeing that people with dates which could possibly be current anytime this year are not seeing any LUD/RFE. If pre-adjudicating is the objective than these cases should have received the RFEs first.

a) LUDs
b) Name Check 180 days rule
c) # of Cards ordered etc etc., etc., is making ppl. more anxious.....

It is simple. If the number of pending EB2 Apps before April 1st 2004 (India and China combined) is less than the number of spill over visa numbers, then there will be some forward movement in EB2 next month. If not, the dates will remain the same or may even retrogress.
what I am trying to say is USCIS works effectively for EB2 category as because they dont have much work in other EB categories.

buddy you're the one sounding the most desparate here.
if all you wanted was a large tv, car, house you could have it anywhere in the world. is that all you came to America for ? is that why you walked the line for years ? if you just wanted a laid back existence you could forget the gc and relax in Tanzania. i think you just desperately want to believe you already have it all. good for you. but then why so perturbed if someone disturbs your illusions... no ... your reality ?
people come to America out of a hunger for limitless opportunities.
many people rightly feel they could do give back much more to this country if they had their freedom. sorry if you're not one of them. after you get your gc you might just vegetate for the rest of your life with the material comforts you've gathered.

would Bill Gates, Larry Ellison, Steve Jobs have been able to even get a eb-xyz GC based on their qualifications ? none of them they would qualify even for eb3 - none of them even have college degrees. so much for this eb3/eb2 nonsense. btw the last two are sons of immigrants. maybe the bureucracy here labels you eb1/eb2/eb3 for its convenince - it'll be sad if we actually start believing it - not just for us but for america and the world. the USCIS bureacracy is NOT what defines america. in fact most americans themselves think it's one of the worst run govt organizations.
the biggest irony of course is that what actually defines america is in in fact ... immigration! a breaking away from the mold of artificial bureaucratic limitations of the old world.
but as they say - be careful what you wish for - that may be exactly what you get.
to the original poster: your question is unnecessarily posed in the negative. a better question would be, what does American gain from recent immigration ? a hint. the answer is not mortgages or uscis receipt fees.

Can someone please respond to this ??
Myself (primary applicant) and my spouse are on h1 with EADs. If spouse starts a company(issue checks and do all admin work) and still maintain her h1 with old employer, will it invalidate her h1 just because she used EAD? Reason for asking is if some thing goes wrong with 485, can she fall back on h1?

Also I was wondering Isn't there a way to upgrade from 50$ to 100$ by changing the amount. I had to sign up for 100$ recurring and cancel the 50$ recurring contribution. Could be just me today :-)
